Name Change in Domicile Certificate

A domicile certificate is the one document in this series that is meant to change. Before correcting the name on an old one, check how old it is: most colleges, scholarship bodies and recruiters want a certificate issued in the last six to twelve months, so a correction can leave you holding an accurate certificate that is still refused.

A name change in domicile certificate can mean two different things. If your certificate is recent, it is an ordinary correction application to the office that issued it, usually the Tehsildar or SDM, supported by identity documents in the correct name. If it is several years old, applying fresh in the correct name is often faster and cheaper, because most institutions want a certificate issued within the last six to twelve months anyway and will not accept an old one regardless of how correct it now is.

Does a domicile certificate expire?

Not in law. But institutions run their own clock, and that is the trap.

A domicile certificate proves permanent residence, and unless your state's rules say otherwise or you acquire domicile of another state, it remains true indefinitely. Most certificates carry only a date of issue and no expiry date at all, which is exactly why people assume theirs lasts for life.

But institutions have their own rules, and they are not the same thing. Colleges, scholarship authorities and recruiters commonly demand a certificate issued within the last six to twelve months, largely because it keeps online verification simple. Your old certificate can be perfectly valid in law and still be turned away at a counselling desk.

There is a middle option worth asking about before you reapply. Where your residence has not changed and you hold continuous proof such as a voter ID, Aadhaar, ration card, utility bills or property records, authorities often endorse or re-verify an existing certificate rather than making you start again. Ask the issuing office before assuming a fresh application is your only route.

Why is domicile the one certificate meant to change?

Everything else in this series is either fixed at birth or preserved as history. Domicile is the opposite.

Which is why the sources describe three distinct kinds of domicile:

  • Domicile by birth, issued to a person born in the state and valid until they permanently relocate.
  • Domicile by choice, for a person who has shifted from their birth state and fulfilled that state's conditions.
  • Domicile of dependence, granted to dependent family members such as children and spouses.
And you cannot hold two at once. A person acquiring domicile in a new state generally has to surrender the old certificate, after meeting that state's residency requirement, commonly ten to fifteen years. So if you have moved, what you need is a fresh application in your current state, not a correction to a certificate from the state you left.

One reassurance for renters, because people assume otherwise. Domicile is residence-based, not ownership-based. Somebody who has rented all their life can establish it with a voter ID, a ration card and a decade of electricity bills. You do not need to own property.

A note that matters, and it is the same one we give on caste certificates. Correcting the spelling of your name on any of these does not create, confer or alter your domicile, residence or indigenous inhabitant status. Those are determined by the authority on its own verification against its own criteria. A correction fixes how you are named on a certificate you already hold; it does not decide whether you were entitled to it.

A general limit worth stating once. Misrepresentation, or producing false documents to obtain a domicile certificate, is punishable under Sections 318 and 336(3) of the Bharatiya Nyaya Sanhita, 2023, which took effect on 1 July 2024 and replaced Sections 420 and 468 of the earlier Indian Penal Code. That applies to any application, not to corrections in particular.

Courts have also held that domicile involves not just residence but an intention to reside permanently, which is why a temporary posting or a course of study in a state does not, by itself, establish domicile there.

How does a domicile certificate correction work?

A revenue office application, not a gazette matter.

Offline

The Tehsildar, the SDM, the Revenue Office, or the District Collector's office that issued the certificate.

Online

Your state's e-District portal, a Common Service Centre, or a Lok Seva Kendra, where the service is offered.

What to submit:

  • The existing certificate, together with identity documents showing the correct name.
  • A self-declaration or affidavit stating the correct details and the reason for the correction, which is commonly required.
  • The gazette notification, where the name has been legally changed rather than merely misspelled, or the marriage certificate or decree as applicable.

Who checks it. The Patwari or Village Level Worker verifies, and may confirm with neighbours or against panchayat records; police verification applies in some sensitive border districts. The SDM or designated authority then approves, and a corrected, digitally signed certificate is issued.

Timeline. Commonly 15 to 21 days, depending on your state's e-District service levels. The statutory Right to Public Services timeline is generally 15 to 30 days, though real-world experience runs from 15 to 60.

Cost. Often nothing. Delhi's revenue department states plainly that no fee is required. Across the country, these certificates are reported free in around a dozen states and between Rs 25 and Rs 50 in about twenty others. If somebody quotes you a large figure, most of it is their charge and not the Government's.

What is different about a domicile application in Delhi?

Delhi's requirements are unusually specific, and they catch people out.

Continuous residence

The last three years, within the territorial jurisdiction of the NCT.

Gazetted Officer attestation

All documents attested by a Gazetted Officer, and you must also supply that officer's own contact number and a copy of their identity card. Not just the attestation; the officer's own details.

Education alone is not enough

Delhi states that only educational certificates for the three consecutive years will not, by themselves, be considered as residence proof.

No fee, and a narrow window

No fee is required. Applications go to the SDM of your area or the office of the Deputy Commissioner, between 10 AM and 1 PM on any working day.

That morning-only window is the kind of thing that wastes an afternoon. Several revenue offices across India operate similarly limited public dealing hours, so check your own state's timings before travelling.

What if my domicile application stalls?

Domicile applications sit more often than most, and there is a straightforward way to move them.

Past 30 days, file a Right to Public Services appeal to the SDM and an RTI to the Tehsildar. Reported experience is that most delays or rejections clear within 7 to 15 days of an RTI being filed, which tells you something about where the file usually is.

A useful five-question RTI, which you can adapt:

  • The status of my application number, dated, as on date.
  • The name and designation of the dealing officer assigned to my file.
  • The reasons for delay beyond the statutory timeline.
  • A copy of any noting or movement of my file in the past 30 days.
  • The likely date of issuance of my certificate or approval.

Two common causes of a stall, both fixable. The Patwari's field verification failed because nobody was home, which is a re-verification request rather than a refusal. Or a school leaving certificate is missing from your residence proof, in which case an RTI to the school, or to the District Education Officer where the school has closed, will produce a record copy.

What if I have moved to another state?

This is a fresh application, not a correction, and it is worth being clear-eyed about it.

Residency requirements are long

Commonly ten to fifteen years of continuous residence, though states differ substantially, and some are considerably shorter.

You surrender the old one

You generally cannot hold domicile certificates from two states at the same time.

Some states count study instead

Karnataka and Telangana, for instance, often grant local status on the basis of seven continuous years of study in the state, including the qualifying examination.

Some place weight on land or classification

Jharkhand and Uttarakhand place weight on ancestral land records; Maharashtra operates classifications within domicile that determine which seat categories you can access.

Marriage is a recognised route. A woman marrying into another state may apply for a domicile certificate in her husband's state. And where a native village was merged into another state at some point, pre-merger documents may still be submitted as proof.

So if your name has changed and you have also moved, do not try to correct the old certificate. Establish the new name on your identity documents, then apply fresh in your current state under that name. Correcting a certificate you are about to surrender is work you will not use.

Doing domicile before Aadhaar is a common mistake, because the verifying officer checks your identity documents.

The finding that shaped it. A domicile certificate does not automatically expire, but many institutions demand one issued within the last six to twelve months, and most certificates carry only a date of issue and no expiry date. That gap between the legal position and the practical requirement is what makes correcting an old certificate frequently the wrong move, and it is the reason this page leads with the certificate's age rather than with the spelling mistake.

Two things we will not pretend about. First, exact residency requirements for acquiring a new state's domicile vary considerably and change by state notification, so the ten to fifteen year figure on this page is a common range to confirm locally, not a fixed national rule. Second, we have not covered eligibility debates, protected status questions, or Jammu and Kashmir's domicile provisions, because this page is about documentation, not about who should qualify.

What this reframes about our own product, honestly. We could take a fee for every domicile correction that comes to us, including ones the client does not actually need. What we do instead is tell a client with an old certificate to apply fresh, and tell a client whose residence has not changed to ask about endorsement before paying for anything.   • Look at the date on your certificate before you do anything. It does not expire in law, but most institutions want one issued in the last six to twelve months.
  • Correcting an old certificate can leave you holding an accurate document that is still refused. Applying fresh in the correct name often solves both problems at once.
  • There are three kinds of domicile: by birth, by choice, and of dependence. You cannot hold two at once.
  • It is residence-based, not ownership-based. Renters qualify with a voter ID, ration card and electricity bills.
  • Use the right word for your state. Nativity Certificate in Kerala and Tamil Nadu, PRC across the north-east, Certificate of Identification in Sikkim.
  • Apply to the Tehsildar, SDM or e-District portal, with the existing certificate, identity documents and a self-declaration or affidavit.
  • Delhi is unusually specific: three years' residence, Gazetted Officer attestation with the officer's own contact number and ID, no fee, 10 AM to 1 PM only.
  • Correction, timeline and fee are state law. Commonly 15 to 21 days, and free or Rs 25 to Rs 50 in most states.
  • If it stalls past 30 days, file an RTPS appeal to the SDM and an RTI to the Tehsildar. Most delays clear within 7 to 15 days after that.
  • If you have moved states, this is a fresh application, not a correction, against that state's own residency requirement.
  • A correction never touches your domicile status. It fixes how you are named, not whether you are entitled to the certificate.
  • Misrepresentation is a criminal matter, under Sections 318 and 336(3) of the Bharatiya Nyaya Sanhita, 2023.
