Your own High Court has held that changing your name is protected by the Constitution, and that a school board cannot simply refuse to record it. Yet the guides people find still tell J&K readers to advertise in Hindi, attach a demand draft, and file at a counter that does not exist. To change your name in Jammu and Kashmir, make a notarised affidavit on local stamp paper, publish the change in two newspapers, one English and one Urdu, then apply to the Central Gazette of India in Delhi with the prescribed proforma and the fee paid through BharatKosh. Your notification appears in Part IV on egazette.gov.in in about 30 to 45 days. The whole file travels by post, and you never need to visit an office.
What does the name change procedure in Jammu and Kashmir involve?
Three stages, done carefully. The complication is the information around them. One page tells readers that everybody must physically submit an application to a gazette department inside J&K, then sends them to the Central Gazette in the next line. Another calls the gazette notification a court order. A third credits the Gazette to a Ministry of Home and Urban Affairs that has never existed. And several instruct J&K applicants to advertise in the regional language, Hindi, which is text written for a different part of the country.
A Gazette notification is a formal announcement of your name change printed in the official journal of a Government. Once it carries a date and a page number, passport offices, UIDAI, banks, JKBOSE, universities and employers treat it as the legal record of your new name. An affidavit on its own is the start of the change, not the finish.

Can a school board simply refuse to change your name?
No. Your own High Court has already answered that, and it is the most useful thing on this page.
Most people starting this process quietly wonder whether they are even allowed to change their name, especially after a counter clerk or a board has said no once. In Mohd. Hassan v. UT of J&K, WP(C) No. 21/2025, neutral citation 2025:JKLHC-JMU:2817, decided in September 2025, a Single Bench of Justice Sanjay Dhar of the High Court of Jammu & Kashmir and Ladakh answered it directly.
The petitioner had asked the Jammu and Kashmir Board of School Education to record his changed name on his High School and intermediate certificates. The Board rejected the request by an order dated 24 December 2024, relying on its own regulation allowing only the correction of transcriptional or typographical errors, and only within three years.
The Court held that the right to adopt or change one's name is a facet of the fundamental right guaranteed under Article 19(1)(a) of the Constitution of India, and that an individual has a fundamental right to adopt a name that gives them an identity of their choice. It rejected the Board's reasoning on the three year window, holding that the limitation applies to transcriptional corrections and not to a substantive change of a particular such as a name. It quashed the rejection order and directed the Board to reconsider the request, and, if allowed, to reflect the changed name in the certificates it reissues.
Two details worth carrying forward. First, this is exactly why the gazette notification matters: it is the clean, dated, public record that a board's own process can then act on, which is why we always advise doing the gazette first and applying to the board with it attached. Second, note the form the Court directed: certificates reissued as Raj Wali alias Mohd. Hassan. Boards frequently record a changed name as an alias rather than erasing the old entry, and that is normal and acceptable.
Which gazette applies to Jammu and Kashmir after 2019?
The Central Gazette. This is the practical consequence of an administrative change, and it decides where your file goes.
Under the Jammu and Kashmir Reorganisation Act, 2019, which received assent on 9 August 2019, the former state was reorganised into the Union territory of Jammu and Kashmir and the Union territory of Ladakh, with the new arrangement taking effect on 31 October 2019. There is no citizen-facing gazette route inside the Union territory for a personal name change. Personal name change notifications for J&K residents are processed through the Gazette of India, published by the Department of Publication in Delhi.
The Union territory does have its own Government Gazette, and it is worth knowing what it is for. It runs under the Jammu and Kashmir Government Gazette Act, 1945 Samvat, that is 1888 A.D., one of the oldest gazette statutes still on the books anywhere in India. That Act started a weekly Government Gazette carrying Acts, departmental orders, notifications, circulars and the appointments, transfers and leave of gazetted officers. Its Section 11 is the reason gazettes matter at all: every entry in the Gazette is presumed to have been made under the orders of a competent authority. That is Government business, though. It is not a window where a private person publishes a name change.
Using the Central Gazette is not a disadvantage. Part IV of the Gazette of India is accepted in every state and Union territory and recognised abroad, which is exactly what you want if your documents have to work for a passport, a central Government job, a bank outside the UT, or a university elsewhere. And the entire file moves by post, so nobody needs to travel.

Four claims about Jammu and Kashmir that are wrong
Each of these is on a page ranking today, and each one costs somebody time, money or a wasted journey.
A gazette counter inside J&K
One page states that every person needs to physically submit the application to the department of Gazette in Jammu and Kashmir, and then in the very next sentence sends the reader to the Central Government Gazette. There is no such counter for personal name changes, and a page that contradicts itself in two consecutive lines has not been checked at all.
Publication in an Official Gazette of J&K
Another page lists a step called publishing of name change in the Official Gazette of Jammu & Kashmir. Personal notices publish in Part IV of the Gazette of India. The Union territory gazette carries Government business under an Act from 1888, not citizen name notices.
The notification called a court order
The same page then describes the gazette notification as a court order you can use. It is not. They are different instruments, and an ordinary name change needs no court involvement whatsoever. Separately, a widely copied page credits the Gazette to a Ministry of Home and Urban Affairs, which does not exist; the Department of Publication sits under the Ministry of Housing and Urban Affairs.
A demand draft, and JPEG documents
Pages still tell readers to attach a demand draft drawn in favour of a Controller of Publications in their own state. That route closed years ago, payment is only through BharatKosh, and no such officer sits in J&K. One advice page also claims all documents must be in JPEG format; the Central Gazette application is a physical file of papers plus a soft copy of the notice text.

Step 1: fix the exact spelling, then draft the affidavit
Choose one exact form of your new name, including the spelling and the spacing, and never vary it again. Then get an affidavit drafted on non-judicial stamp paper stating your old name, your new name, your father's or husband's name, your full address in the Union territory and a clear reason for the change, and sign it before a notary or oath commissioner. Jammu and Kashmir traditionally uses low denomination stamp paper, so ask your notary in Srinagar, Jammu or your district town what value is current rather than assuming the figure that national guides quote. Stamp paper and notary together usually cost Rs 100 to Rs 500.
Step 2: publish in two newspapers, one English and one Urdu
Publish the same notice in two dailies that genuinely circulate where you live: one English and one Urdu. This is the pairing J&K applicants use and the one the Department is used to seeing from this Union territory. The notice must carry your old name, new name, full address, age, father's or husband's name, the date of the affidavit and the notary's name. Keep the complete original printed page of each newspaper with the date clearly visible, not a cutting. Two notices usually cost Rs 800 to Rs 4,000. Step 3: prepare the Central Gazette file
Your file for the Department of Publication contains the original newspaper pages, a signed undertaking showing the old and new name with parentage and address, two copies of the prescribed proforma computer typed and not handwritten, signed and attested, a soft copy of the notice text as the department directs, a certificate signed by you declaring that the hard copy and the soft copy match, self-attested identity proof of the applicant and of one witness, two self-attested passport size photographs, a request letter to the Controller of Publications, and an attested copy of any connected legal or medical document your case involves. Keep every supporting document less than one year old.
Step 4: pay the fee through BharatKosh only
The fee is paid only through bharatkosh.gov.in, the Government's Non-Tax Receipt Portal. It is commonly Rs 1,100 for an adult and Rs 1,700 for a minor, with an additional fee per alias if you publish aliases. The Department of Publication revises these amounts each financial year, so confirm the current figure on deptpub.gov.in before paying. The fee is not refundable, and demand drafts are no longer accepted.
Step 5: post the file and download your notification
Send the complete file by post or courier to the Department of Publication, Civil Lines, Delhi 110054. Speed post from Srinagar or Jammu works exactly as well as a hand delivery in Delhi, though allow a few extra days each way. Applications are accepted from the applicant directly, not from agents, which is why an honest consultant prepares your file end to end while you sign and send it. Your notification then appears in Part IV of the Gazette of India, in weekly Saturday dated issues. Physical hard copies ceased on 1 October 2015, so you open the issue on egazette.gov.in, search the PDF for your old or new name, and download the whole gazette as your own copy. It needs no further certification.

Plan for about 4 to 8 weeks from the first phone call to a notification you can download. We quote a little more than the national figure on purpose, because postal time both ways and occasional local disruption are real, and it is better to build them in than to be surprised by them.
Which newspaper language, and what about spelling variants?
Two questions that decide more J&K files than anything else, and the templated pages get both wrong.
Why English and Urdu, not Hindi
Urdu became the court and official language of this region in 1889, when Maharaja Pratap Singh replaced Persian with it, and it stayed the sole official language for 131 years. Since the Jammu and Kashmir Official Languages Act, 2020 (Act 23 of 2020), which received assent on 26 September 2020 and commenced three days later, the Union territory has five official languages. Section 3 of that Act says that Kashmiri, Dogri, Urdu, Hindi and English shall be the official languages to be used for the official purposes of the Union territory, with effect from a date the Administrator appoints by notification in the Official Gazette. The same instrument you are about to use for your own name.
So a Hindi notice is not unlawful. It is simply not what is used here. English and Urdu is the pairing J&K applicants publish in, the pairing local dailies actually serve, and the pairing the Department is used to receiving from this Union territory. Any guide that instructs a J&K reader to publish in the regional language, Hindi has pasted in text written for another state, and that single copied line is one of the clearest signs that the rest of the page has not been checked either.
Spelling variants across Urdu and English records
This is the second question, and it is where a lot of J&K files actually come from. The same name reaches English in different forms across decades of records, especially where older entries were written from Urdu or from speech by clerks working at speed.

What it costs, and what fixes it
To a Government database, two spellings are two people. Nothing goes wrong until an office needs two documents to match, and then it becomes a passport delay, a bank KYC block or a job verification query, usually at the worst possible moment.
A gazette notification declaring one final spelling gives every office a single version to follow, instead of you correcting one document at a time and hoping they converge. The name stays yours. What you are deciding is the written form, once, on purpose.

Is a birth certificate mistake a gazette matter in Jammu and Kashmir?
No. If the error sits in a birth certificate, whether it is a wrong spelling, a wrong parent name or a missing child name, the fix is a Registrar correction under Section 15 of the Registration of Births and Deaths Act, 1969. You apply to the body that issued the certificate: your Municipal Corporation, Municipal Committee or the local registrar. The Civil Registration System portal is crsorgi.gov.in.
A gazette notification can support the file, but it does not rewrite the certificate itself. Agents who push every birth certificate case into a gazette application are charging you for the wrong process, and the Registrar route is usually both cheaper and faster.

Which special situations come up most in Jammu and Kashmir?
Four cases we see constantly, starting with the one the High Court addressed.
School and board certificates
This is the most common reason people here start the process, and it is exactly the situation in Mohd. Hassan v. UT of J&K. If JKBOSE or another board has refused to record your changed name, the position is that it cannot refuse outright, and it cannot rely on a three year window written for typing errors to shut out a genuine name change. Get the gazette notification done first, so the board has a dated public record to work from, then apply through the board's own correction process with the notification attached. The board still applies its verification, and its procedure decides the outcome, but a flat refusal is not the end of the road.
Working or studying outside the Union territory
Plenty of families have members studying or working in other states, and that is usually where a name mismatch surfaces, in a hostel admission, a bank KYC or an employer's background check. The Central Gazette handles this cleanly, because Part IV is valid everywhere in India. The file can be prepared and posted from wherever you are, and family at home can send it if that is easier, as long as the papers carry your own signature.
Marriage, divorce and a minor child
A woman adding a husband's surname follows the same three stages with the marriage certificate attached. Reverting to a maiden name after a divorce follows the same route with the decree attached. If you keep using your existing name and nothing on paper changes, you do not need a gazette at all. For a minor, a parent or legal guardian applies, swearing the affidavit and attaching the child's birth certificate. The minor fee applies, commonly Rs 1,700 with the usual revision caveat, and both parents signing avoids objections later.
Applying from abroad
Execute the deed, get it attested by the Indian Embassy or Consulate, then apply to the Central Gazette and budget around Rs 7,500 to Rs 9,000. Part IV is recognised by foreign missions, which is precisely why it is the anchor document for anyone whose records have to work outside India, and the final notification downloads from egazette.gov.in anywhere in the world.
What changes for Government employees?
Central Government employees follow the Ministry of Home Affairs Office Memorandum No. 190016/1/87-Estt.(A) dated 12 March 1987: a deed of change of name is executed and routed through the department, so that the service book is updated alongside the gazette notification.
Union territory Government employees should likewise inform their department rather than doing the gazette quietly. A service record that does not match the published name creates a second problem, usually at promotion or pension, years later. Ask your department one thing before you spend anything: what it wants on the record and in what order. Send us any departmental circular and we build the file around it.
What names does the law not allow, and what do you gain by doing it properly?
You may take almost any name you like. Almost.
Names that will not be accepted
- A name taken in order to hide your identity
- A name taken to escape a debt, a liability or a legal proceeding
- A name that is obscene or offensive
- A name containing punctuation marks or symbols
- A name that impersonates another person for gain
A change of name does not erase anything behind you. Your old records stay linked through the notification itself, which names both the old and the new name. That is the point of publishing it.

How can I change my name legally in Jammu and Kashmir?

Is there a gazette office in Jammu and Kashmir?
Not for personal name changes. Since the reorganisation took effect on 31 October 2019, name change notifications for J&K residents are processed through the Central Gazette, and the file goes to the Department of Publication, Civil Lines, Delhi 110054, by post.
Can a school board refuse to change my name on certificates?
Not outright. In Mohd. Hassan v. UT of J&K the High Court of Jammu & Kashmir and Ladakh held that the right to adopt or change one's name is a facet of the fundamental right under Article 19(1)(a), quashed JKBOSE's rejection, and held that a three year window written for transcriptional errors does not apply to a genuine name change.
Which newspapers should I use for the notice?
One English daily and one Urdu daily circulating where you live. Urdu has been an official language of the region since 1889 and remains one. Hindi is also an official language of the Union territory since the 2020 Act, but it is not the usual choice here.
What is the Government fee for a gazette name change?
Commonly Rs 1,100 for adults and Rs 1,700 for minors, paid only through bharatkosh.gov.in. The Department of Publication revises the fee each financial year, so confirm the current amount on deptpub.gov.in before paying, and remember it is not refundable.
Is a gazette notification the same as a court order?
No. They are different instruments, and an ordinary name change involves no court at all. Pages describing the notification as a court order you can use have confused the two, which is worth knowing before you go looking for a lawyer you do not need.
