Name Change After Divorce

Almost every page on this subject says a gazette notification is compulsory and that a divorce decree is not valid proof of a name change. That is the wrong way round. A certified copy of the decree is the standard proof, and a gazette is the fallback for one specific situation. Which of the two you need turns on a single thing you can check in five minutes, for free, before you speak to anybody.

For a name change after divorce, a certified copy of the decree or court order is the standard supporting document. A gazette notification is the fallback, used where no single document links your old and new names. What does the search result you just left get wrong?

Nearly all of them say the same thing, and it is the opposite of what the forms actually ask for.

How do you know whether you need a gazette after divorce?

One test settles it, and you can do it now with a document you already have.

Take out your certified copy of the decree and look for the name you are reverting to. Is it in there, spelled exactly the way you want it going forward? That is the whole test. No competitor page asks the reader to do it, and it costs nothing.

If the maiden name is in the decree

The decree is doing the job it is meant to do: it links the two names in one document. A certified copy is the standard supporting proof, and a gazette is generally not needed. Take copies, because several institutions will each want to see one.

If it is not, or the spelling differs

Then no single document connects your old name to your new one, and that is exactly the gap a gazette notification is built to close. This is the case a gazette is genuinely for, and here it is worth the money.

If a service tells you the decree is not legally valid for a name change, they are wrong. Both instruments are legitimate and they are for different situations. Ask them, plainly, whether they have read your decree and whether your maiden name appears in it. If they cannot answer that, they have not looked at your papers.

Do you have to change your name after a divorce?

Worth saying first, because a number of pages imply an obligation that does not exist.

Nobody has to revert. A divorced person may keep the surname they have been using, revert to a maiden or original name, or adopt something different. There is no deadline, no expiry and no legal requirement either way. You can do it next month, in ten years, or not at all.

And nobody can make you. A former spouse cannot compel you to stop using a surname, and no order in a divorce does that by itself. A decree dissolves a marriage. It does not rename anybody.

Reasons people keep the married name

Children who share it. A professional record built under it. A licence or registration in it. Or simply not wanting the administrative work. None of these needs justifying.

Reasons people revert

Wanting the record to match how they are known. Closing an administrative chapter. Or a document set that will be simpler afterwards. Equally valid, and equally nobody's business.

Why does the Aadhaar limit matter more after a divorce?

Because of the arithmetic. It bites harder here than for anybody else, and it is the reason to slow down for a day.

A name update on Aadhaar is permitted twice in a lifetime. If you changed your name when you married, you have used one. This reversion will use the second. After that, a further change needs a special exception from a UIDAI Regional Office under the published procedure of 28 October 2021, which is not something to plan around.

So a marriage and a divorce together can spend both permitted changes within a few years. That is the position most people reading this page are in, and almost nobody is told it before they queue at a counter.

Two facts that make care worth a day of your time

The fee is charged per attempt

The demographic update at an Aadhaar Enrolment Centre is Rs 75 including GST, stated as applying from 1 October 2025 to 30 September 2028. A biometric update on its own is Rs 125. The demographic fee is charged per attempt and is not refunded if the request is rejected. Confirm the current amount at the centre.

Rejections happen for exactly this reason

Requests are turned down where the supporting document does not show the connection between the old and the new name. When that happens the fee is gone and the attempt is spent. This is precisely why the decree is worth reading before you book, not after.

Why the Update Request Number matters more than people think. Without the URN you cannot file a grievance, an RTI application or a first appeal if something goes wrong. It is the reference every one of those routes asks for. A photograph of the acknowledgement slip takes two seconds and is the difference between having a remedy and having none.

Treat this attempt as your last one, because it may well be. That is not a sales line. It is the arithmetic of two permitted changes, one of which you have already spent.

What does a certified copy of the decree actually do?

It links two names in one Government document, which is the only thing any of these offices is looking for.

Every office in this process is asking the same question in a different form: can you show that the person named on the old record and the person named on the new one are the same person. A decree that records both names answers it in one page. That is why it works, and it is also why a decree that records only the married name does not.

Get more than one certified copy

The Aadhaar centre, the PAN application, the bank and the passport office will each want to see one, and some will retain it. Ordering several at once from the court saves a second trip and a second wait.

Check the spelling against your hardest document

Usually a board certificate or a live passport. If the decree spells the maiden name differently from those, decide now which spelling stands, because you are about to spend your last permitted Aadhaar change on it.

The court's own timeline applies

A certified copy is issued by the court that passed the decree, on its schedule rather than yours. Start this first, because everything else waits on it.

Where the decree stops

It evidences the dissolution and, where it records both names, the reversion. It does not correct a mismatch that existed before the marriage, and it does not create a name that appears nowhere in it.

What is the gazette route, if your case needs one?

For the cases in the table above where the decree cannot bridge the two names, the route is the ordinary one.

1. The notarised affidavit

On stamp paper, stating your existing name, the name you are reverting to or adopting, your parentage and address, and the reason, referring to the decree.

2. Two newspaper advertisements

One English and one in the regional language, with the complete original pages kept. Cuttings are refused.

3. The prescribed file

To the Department of Publication, Civil Lines, Delhi 110054: the proforma in duplicate, the undertaking, the soft copy and identity documents, with a certified copy of the decree attached as the supporting document.

4. The fee, then publication

Paid only through bharatkosh.gov.in, commonly Rs 1,100 for an adult, non-refundable and revised each financial year. Publication in Part IV follows in about 30 to 45 days, downloaded free from egazette.gov.in.

Several states also run their own gazette routes, which can be cheaper and quicker for records held inside that state. But if your purpose is a passport, or anything outside your state, the Gazette of India is what those offices look for. Two things you will be told that are not true. No court petition is required. You do not need to obtain a court order to change your name, and a page telling you to file one is describing something else entirely. And no compact disc is required: the soft copy is submitted as a file, and any list asking for a CD is years out of date.

How does a passport name change after divorce work?

The passport is usually the most sensitive document in this process, for reasons that have nothing to do with paperwork. So here is exactly what the form asks.

The Government's own booklet answers the whole question. Passport Seva's instruction booklet carries a re-issue row headed “Divorcees/ Separated applying for change of name OR for deletion of spouse's name in existing Passport”. The documents it asks for are: the old passport with the prescribed self attested photocopies, and, if divorced, a “Divorce Order/Decree (if name/surname change is based on divorce)”. That is the list. No affidavit, no newspaper notice, no gazette and no court petition appears in it.

Reverting your own name

A name change is processed as a reissue, not a correction. You apply on the Passport Seva portal under Reissue, then Change in Personal Particulars, and you receive a new booklet with a new number. The certified copy of the decree is the supporting document.

Expect police verification. It is generally conducted when reverting to a maiden name after a divorce, and it confirms your address and validates the decree. Keep the address proof consistent with what you have filed.

Removing a former spouse's name

This is a different and smaller request, and it is worth knowing what the result looks like, because people ask us this more often than anything else on this page. You apply for a reissue and submit the decree. Once approved, the new booklet simply shows a blank in the spouse name line.

There is no mark, no annotation and no note explaining why. It reads exactly as an unmarried person's passport reads. Nobody looking at it learns anything about your circumstances. This is the answer people are usually relieved to hear, and it is worth saying plainly rather than leaving it to be guessed at.

Removal of a spouse's name alone, without a change to your own name, typically does not require police verification, though that depends on your case and on what the passport office system indicates. Separately, the Ministry of External Affairs treats a divorce decree, a death certificate, a re-marriage certificate or a joint declaration as the documents that remove or update a spouse's name.

A note on Tatkaal, stated carefully

You will read that Tatkaal is not available for a name change. That is true of a fresh passport applied for with a change in name, where the booklet says the applicant cannot apply under the Tatkaal scheme. For the re-issue row for divorcees, the booklet sets out the same two documents under both the Normal and the Tatkaal columns. Because these two situations are frequently written about as if they were one, confirm your own case on the Passport Seva portal before you book an appointment rather than planning a timeline around a blog, including this one.

Sequence matters here more than anywhere. Update Aadhaar and PAN before the passport, so the supporting documents already agree with one another. A passport application arriving with mismatched identity documents is the commonest cause of a file being held, and the hold is invisible until it has already cost you weeks.

Which record should you update first after a divorce?

The first four decide whether the rest go smoothly. Once Aadhaar, PAN, the bank and the passport agree with each other, every later form has a consistent set of documents to copy from, and a counter that would have queried you simply does not.

If the decree does the work, most people are through the main documents in about six weeks. If a gazette is needed first, add roughly six weeks at the start. There is no expedited Government processing on the gazette route.

What mistakes do people make with a name change after divorce?

Every one of these is avoidable, and most of them cost either money or the last permitted Aadhaar change.

Buying a gazette without reading the decree

The single most expensive mistake here, and the one this page exists to prevent. Read the decree first. If your maiden name is in it, the case for a notification largely disappears.

Believing the decree is not valid proof

It is the standard supporting document. A page saying otherwise has the position exactly backwards, and is telling readers to buy something they may not need.

Believing you must file a court petition

You do not. No court petition is required for a name change after divorce. A page telling you to obtain a court order for this is describing a different process entirely.

Going to the Aadhaar centre without checking the spelling

And spending your last permitted name change on a rejected attempt, with a fee that is not refunded.

Losing the Update Request Number

Without which no grievance, RTI or first appeal can be filed. Photograph the acknowledgement slip the day you receive it.

Applying for the passport too early

Before Aadhaar and PAN are updated, so the supporting documents contradict the application and the file is held.

Assuming certificates must be changed

School and degree certificates usually need not be. A certificate earned under a name remains valid under that name.

Forgetting the nominees

Changing your own name does not change a nomination. Insurance, provident fund, bank accounts, mutual funds and pensions may still name a former spouse.

The one question to ask any service before paying. Does my decree record my maiden name, and if it does, why do you think I need a gazette? If they cannot answer that, they have not read your papers, and you are being sold a product rather than advice.

Does changing your name update your nominees?

No, and this is the item most often forgotten in the whole process.

A change to your own name does not change a nomination. Insurance policies, provident fund, bank accounts, mutual funds and any pension scheme may still name a former spouse as nominee or beneficiary long after every identity document has been updated. If you want those altered, that is a separate instruction to each institution, on each institution's own form.

Where to look

Life and health insurance, EPFO or the universal account number, bank accounts and lockers, mutual fund folios, demat accounts, and the National Pension System.

Why it is missed

Because none of these asks you about it while you are updating your name. The name change form and the nomination form are different forms, often at different counters.

When it matters

At exactly the moment nobody is available to fix it. This is a twenty minute job now that saves a family a very long one later.

And your old school and degree certificates?

They usually need not change at all. A certificate earned under a particular name remains valid under that name. Most people leave them alone and use the decree, or the gazette, to bridge the two when asked. Boards and universities have their own rules and their own fees if you do want them altered, and it is worth asking what they actually require before assuming a change is necessary.

Changing a child's surname

This is not a documentation question. It involves consent, sometimes a court, and it can be contested. The rules differ from an adult's own name change and the consequences of getting it wrong are serious. Take proper legal advice from a family lawyer, and be wary of any service offering you a straightforward process for it. What do the terms on these forms actually mean?

Twelve definitions, each written to stand on its own.

Certified copy of the decree
A copy of the divorce decree or court order issued and attested by the court that passed it. This is the standard supporting document for a name change after divorce, and it works because it can link the old name and the new one in a single Government document.
Reversion
Returning to a maiden or original name after a divorce. It is a choice rather than an obligation, has no deadline, and cannot be required by a former spouse or created automatically by a decree.
Gazette notification
The publication of a change of name in an official Government journal. After a divorce it is the fallback instrument, used where the decree does not record the name being reverted to, and it bridges two names that no single existing document connects.
Part IV
The part of the Gazette of India in which personal change of name notifications appear. It belongs to the Central Gazette only. A State Gazette carries its own numbering, so a page that puts a state gazette in Part IV has copied a Central page.
Reissue
The passport process used for a change in personal particulars. The existing booklet is not edited: a new passport is issued with a new number, and police verification is generally conducted where a maiden name is being restored.
Deletion of spouse name
A passport request to remove a former spouse's name from the booklet. It is treated separately from a change to your own name, and the reissued booklet is commonly reported to show the spouse name line simply blank, with no mark or annotation.
Update Request Number
The tracking reference printed on the acknowledgement slip given at an Aadhaar centre. Without it a grievance, an RTI application or a first appeal cannot be filed, so the slip should be photographed on the day it is issued.
Demographic update
An Aadhaar change to name, address, date of birth, gender, mobile or email, as distinct from a biometric update. It is charged per attempt and the fee is not refunded if the request is rejected.
Exception handling process
The UIDAI route for a name update request that falls outside the ordinary permitted number, governed by a published standard operating procedure dated 28 October 2021 and decided by a Regional Office rather than at a counter.
Nomination
The instruction naming who receives a policy, account or fund on death. It is entirely separate from a name change, does not update when your name does, and must be altered institution by institution if a former spouse is still named.
Registrar correction
A correction to a birth or death entry made by the registering authority under Section 15 of the Registration of Births and Deaths Act, 1969. It is a different application to a different office and no gazette replaces it.
BharatKosh
The Government of India Non-Tax Receipt Portal at bharatkosh.gov.in, through which the Central Gazette fee is paid. It is the only accepted channel, and the payment is non-refundable.

Frequently asked questions about a name change after divorce

Do I have to change my name after a divorce?

No. You may keep the surname you have been using, revert to your maiden or original name, or adopt a different one. There is no deadline and no legal requirement either way.

Can my former spouse make me stop using their surname?

No. Nobody can compel you, and a decree dissolves a marriage without renaming anybody. There are practical reasons people keep a married name, including children who share it and a professional record built under it, and none of them needs justifying.

Is a gazette notification compulsory after divorce?

No, despite what most pages on this subject say. A certified copy of the decree is the standard proof. A gazette is the fallback where the decree does not clearly record the name you are reverting to.

How do I know which applies to me?

No. Reporting of UIDAI's own site is that only the address can be updated online. A name update requires physical presence at an Aadhaar Seva Kendra or Enrolment Centre with biometric authentication.

Is the passport corrected or replaced?

Replaced. A name change is processed as a reissue and you receive a new booklet with a new number, applied for under Reissue and then Change in Personal Particulars.

What document does the passport office want?

Passport Seva's instruction booklet, in the row for divorcees applying for a change of name or for deletion of a spouse's name, lists the old passport with the prescribed photocopies and, if divorced, a Divorce Order or Decree. No affidavit, newspaper notice or gazette appears in that row.

Is police verification required?

Generally yes when reverting to a maiden name after divorce, because it confirms your address and validates the decree. Removing a spouse's name alone typically does not require it, though that depends on your case and what the passport office system indicates.

Can I use Tatkaal?

Be careful with what you read here. A fresh passport applied for with a change in name cannot use the Tatkaal scheme. For the re-issue row covering divorcees, the booklet sets out the same two documents under both the Normal and the Tatkaal columns. Confirm your own case on the Passport Seva portal before booking.

Do I need to change my school and degree certificates?

Usually not. A certificate earned under a particular name remains valid under it. Most people leave them and use the decree, or the gazette, to bridge the two when asked. Boards have their own rules and fees if you do want them altered.

What about my nominees?

Changing your own name does not change a nomination. Insurance, provident fund, bank accounts, mutual funds and pension schemes may still name a former spouse, and each needs a separate instruction if you want that altered. It is the item most often forgotten.

Can I change my child's surname?

That is a different matter involving consent and sometimes a court, and it can be contested. Take proper legal advice from a family lawyer rather than treating it as documentation work, and be wary of any service offering a straightforward process for it.

I am widowed rather than divorced. Does this apply?

The same routes apply, with a death certificate in place of the decree, including for removing a spouse's name from a passport.

Do I need to submit a CD with the gazette application?

No. The soft copy is submitted as a file. Any list asking for a compact disc is years out of date, and it usually travels on the same page as a demand draft that is also no longer accepted.

How long does the whole thing take?

About six weeks for the main documents if the decree does the work, and roughly six weeks more at the start if a gazette is needed first. The certified copy of the decree is issued on the court's own timeline, so start that before anything else.

What should I ask a service before paying?

Whether your decree records your maiden name, and if it does, why they think you need a gazette. If they cannot answer that, they have not read your papers.

An earlier blog on our own network stated that the gazette is the only legally accepted name proof in India for a divorce based name restoration, and listed using only the divorce decree among common mistakes. That is wrong, and it is wrong in the direction that costs the reader money. The decree is the standard supporting document and the gazette is the fallback. This page is written to replace that one, and we would rather say so here than quietly change it.

What we verified on an official source, and it settles the argument. Passport Seva's own instruction booklet contains a re-issue row headed “Divorcees/ Separated applying for change of name OR for deletion of spouse's name in existing Passport”. The documents it requires are the old passport with the prescribed self attested photocopies and, if divorced, item 57, which the booklet defines as “Divorce Order/Decree (if name/surname change is based on divorce)”. No affidavit, no newspaper notice, no gazette and no court order appears in that row. When a Government form asks a divorcee for two documents and a website asks for five, the form is the one to believe.

On Aadhaar, and how far we can vouch for it. UIDAI publishes a Standard Operation Procedure dated 28 October 2021 titled Name and Gender Update Request under Exception Handling Process, which is the clearest published evidence that the ordinary route has a limit. The commonly stated limit is two name updates in a lifetime. The demographic update fee at an Enrolment Centre is Rs 75, revised upward from Rs 50 with effect from 1 October 2025 and stated as applying to 30 September 2028, with a biometric update alone at Rs 125. That the fee is charged per attempt and is not refunded on rejection, and that the Update Request Number is required for any grievance, RTI or first appeal, come from a practical guide rather than from a Government page. We could not open UIDAI's own document list directly while writing this, and we say so rather than implying otherwise. Confirm on uidai.gov.in or on 1947 before you travel to a centre.

On the blank spouse line. That the reissued booklet shows the spouse name line blank, with no mark or annotation, comes from consistent reporting rather than from a published Passport Seva statement. We have printed it because people ask constantly and are relieved by the answer, and we have said where it comes from.

What the rest of these results say, for the record. Several well ranked pages state that gazette publication is mandatory and the only legally valid proof. One instructs readers to file a petition in court and obtain a court order, which is not required at all. Another still asks for a compact disc. Each of those sends a reader to spend money or time on something the forms do not ask for.

What we deliberately did not write. No opening line about a new chapter or a fresh start. Not everybody reading this chose it, and a page about paperwork has no business assuming anything about your circumstances, your gender or who wanted what. We also give no procedure at all for changing a child's surname, because that involves consent and sometimes a court, it can be contested, and a documentation service that hands out a confident method there could cause real harm.
